just returned from the Philadelphia area where we are setting
up a conference.

I am often asked why costs of
conferences differ from place to place and from one organization
to another. There are many reasons. Some conferences provide
lunch and some do not. Some hotels charge more than others.
Costs of mailings & preparation for the conferences may differ
depending on how many mailings are sent out and how much support
is given by local members and local professionals (bless those
that help!!) We have to get the organizers to the conference
area and pay their expenses while they are there. Sometimes the
persons have to travel to the area twice to set up a function.
For what consumers receive from these conferences, we think that
they are reasonably priced. NO-ONE IS MAKING ANY MONEY
PUTTING ON THESE CONFERENCES, even though some have been
accused of doing so!! The last one I did I actually came out
almost $200 in the hole (after accounting for all expenses, because
my copy machine costs tripled from what I thought they would be.
A $300 cartridge actually made 12,000 copies instead of the 21,000
it made the previous time. Also, I did not include some fax charges,
misc. expenses, & never include gas and car expenses). I
donated frequent flyer mileage points to get a speaker to one
conference and will probably do it again (soon) to help out.
Please do not criticize the groups that put on these conferences!!
We need your help!!! We are trying to do this to help the consumers.
If you have a problem with this, contact the person(s) putting
on the conference for an explanation. If you are criticizing
our group leaders, shame on you!! They give their time, their
energy, their money and their dedication to this cause! What
are you giving??
LEGAL INFORMATION:
On April 7th, Dow Corning
moved to separate breast implant claims into two categories: 1)
Those based on autoimmune diseases and 2) Those involving ruptures
and local complications. That is when you received the omnibus
objections to the breast implant claims. Hazelton of Dow Corning
stated that these motions were based on scientific evidence from
other courts that disprove claims that breast implants cause disease.
Judge Spector has not ruled on DC's motion. DC also requested
a hearing to designate Judge Pointer of Alabama as a special judge
to sit on the Sixth Circuit. According to what we have been able
to find out, these are delaying tactics by DC and are designed
to frustrate BI consumers and their attorneys and make them give
up and go away. It is working well, especially with attorneys.
A hearing has also been held to
decide whether Dow Corning has exclusive rights to determine their
reorganization plan. The debtors may not file a plan as long
as DC holds exclusive rights to do so. The hearing was April
16th and arguments were heard on May 1st. The judge refused to
hear the debtor's plan and has had no response on DC's plan. Judge Sam Pointer has reinstated Dow Chemical as a federal defendant in the multidistrict litigation. Dow Chemical's protestations that thousands of claims against them have been dismissed is pure posturing. 3 claims against them have been dismissed, all being appealed. Warnings that date back to the 1950's including internal research by both Dow Corning and Dow Chemical indicate that silicone gel used in breast implants was biologically active. Three cases have gone to trial against Dow Chemical, including the Texas one in which the verdict has been set aside and is in limbo, the Nevada (Mahlum) case in which the State Supreme Court has heard the appeal of our win and has not yet responded, and the current Spitzfaten Class Action in Louisiana. Dow Chemical's removal from a case in California is being appealed to the state Supreme Court. In Louisiana, Judge Yada Magee has found sufficient evidence to proceed on the plaintiffs' claims of fraud, conspiracy, negligence, responsibility for the product and aiding and abetting in the development of a harmful product. (Yah, Judge Magee!!) She has also ruled that, under Louisiana law, Dow could not be held liable for product warranty, but could be potentially liable for involvement in early safety testing. Dow Chemical was dismissed from all Michigan Breast Implant Cases and this decision is being appealed. This decision has been upheld in the Appeals court. This one will no doubt end up in the U.S. Supreme Court for a decision.
We had one small win ($35K). In
N.M. (Duke v. 3M), the Judge denied the defendants' (3-M and McGhan)
motion to exclude every one of the plaintiff's experts (Pierre
Blais, Saul Puszkin, James O'Donnell, Eric Gershwin). Defendants
had tried to use Daubert vs. Merrill Dow Pharmaceuticals as the
basis of the appeal. The Judge ruled that the focus should be
on the validity and soundness of the scientific method used to
generate the evidence and not just whether it had gained general
acceptance within a particular field (another wise Judge).
Meanwhile, Baxter (Heyer-Schulte
implants) has filed for a summary judgment on two claims (Pennsylvania
Court). These two are that there was a common plan to prevent
public awareness of the hazards of breast implants (does anyone
doubt this??) and for conspiracy and concert of action. Plaintiffs
in the action state that Baxter has no authority to file a summary
judgment motion.
3-M is fighting probes into its
divestitures. They argue that they should not be compelled to
turn over documents on divestiture of some of their product line
because the documents are of a highly sensitive, confidential,
proprietary financial nature and that these transactions are irrelevant
to breast implant litigation. They also state that it would be
overly burdensome for them to comply with this request.
Whatever happened to GE as a defendant?
I understand that they made the gel for many implants, including
most if not all of the pre 9/7/86 Surgitek implants. Why are
they not among the defendants in the class action or in individual
suits? If they are being sued, please inform me of when and where!!
Women are asking!!
A Federal District Court in Idaho
allowed a woman to amend her complaint against Bristol-Meyer-Squibb
and ask for punitive damages. In granting this request, the Judge
ruled that there was enough evidence that the testing and marketing
of silicone breast implants was oppressive, fraudulent, wanton,
malicious or outrageous and that the inclusion of punitive damages
would not result in undue prejudice to the defendants. Med. Eng.
and Dow Corning are also defendants in this lawsuit (Taylor vs.
Surgitek, Inc. and other defendants).
CUI (Cox-Uphoff Implants) consumers:
It is unclear whether the Judge will allow or grant a Mandatory
Class Status as this has been under a pending motion since August,
1966. CUI claims to have no money (don't you just feel sorry
for them???) Be sure to opt-out of the class action if you only
had CUI implants as that gives you 6 months before your statute
of limitations begins to toll. Finding an attorney to handle
these cases has been virtually impossible. We all hope that Judge
Pointer will create a class action settlement for women who have
been victimized by implants from this company and/or will file
an order dealing with statutes of limitations regarding women
with these implants. File a complaint directly with CUI (be sure
to include your proof of manufacturer and proof of rupture) after
you opt-out of the class action. Meanwhile the one lawsuit that
moves forward against this defendant (California) has not yet
reached a trial date.
More on attorney's charges!!
They cannot charge you extra for faxes or copies or anything but
a doctor's lien over the 10% ($10,000 and under) or whatever percentage
is listed in the class action (maximum 23% of $100,000) if your
settlement is from the MDL or from Mentor/Bioplasty. Any charges
over the listed percentage should be reported to Judge Ann Cochran,
Claims Administrator, MDL 926, P.O. Box 5666, Houston, TX 77256.
Send a copy of the attorney's accounting & include the attorney's
name, address & phone #. As I said before, if the attorney
refuses to make an accounting (an itemized statement), report
that to your state bar association and to Judge Ann Cochran.
MEDICAL INFORMATION:
A new method for detecting
silicone and its concentration in animal and human tissues has
been discovered by Dr. Russell Lebovitz of Baylor College of Medicine
(Houston). This study was published in the April issue of Analytical
Chemistry so should meet the criteria set out in Daubert v. Merrill
Dow Pharmaceuticals. A gas chromotograph permits scientists to
identify silicone, an atomic emitter is used to determine the
amount of silicone and a mass spectrometer is used to determine
the kind of silicone. Dr. Lebovitz says this is the first step
in a process that will determine if women with silicone B.I. and
patients with other medical silicone devices are suffering from
problems caused by silicone migration. (Hang on folks, the science
is beginning to catch up with our illnesses!!)
INOSITOL, also called myo-inositol.
What is it and what does it do? Inositol is a B Vitamin, somewhere
between Vitamin B6 and B12. It is available from natural or synthetic
sources & is not a prescription drug. Inositol plays a role
similar to choline in helping move fats out of the liver. No
RDA for this vitamin has been established.
What does it do? Many women have
claimed that they feel much better on this vitamin. They state
that they have more energy and that they feel much healthier.
Some ways Inositol may be helpful: It may protect against cardio-vascular
disease. It may protect against peripheral neuritis that is associated
with diabetes. It may protect against hair loss as it helps to
maintain healthy hair function. It functions as a mild anti-anxiety
agent. It can help control blood cholesterol. It promotes the
body's production of lecithin. It has stimulating effects on
the muscular action of the alimentary canal, so helps with constipation.
It can be depleted in anyone who drinks heavy caffeine products
(coffee, tea, colas, sodas, etc.). Some animals have been shown
to be deficient in Inositol. Human tests are being developed.
Inositol forms an important part of phospholipids which are compounds
manufactured in our bodies.
If you have major liver problems
or gall bladder problems, consult your doctor before taking Inositol
as the silicates the body sheds (from taking Inositol) will go
through your liver. Don't take this vitamin if you are healthy,
over 55 and healthy or if you are pregnant and breast-feeding
and healthy. If unhealthy and these conditions apply, consult
a doctor. If you have diabetes with peripheral neuropathy, consult
a doctor. There is no known interactive effect on lab tests.
No study on children's benefits have been done.

A study published in a recent
issue of Obstetrics & Gynecology concluded that 64% of new
mothers who had breast implants had an inadequate supply of milk
and were therefore slower to breast feed. Only 10% of new mothers
generally have problems with their milk supplies. This information
is from Medical-Legal Aspects of Breast Implants, April 1997.
If you drink grapefruit juice
(or eat a lot of grapefruit), don't drink it with medications
as it can have severe consequences such as quintupling the effects
of many medications (increasing the potency as much as 5 times),
especially blood pressure pills and antihistamines. It may affect
other drugs.
Research has shown that persons
with fibromyalgia have more substance P in their spinal fluid
than other persons. Substance P is a neuropeptide that carries
pain signals. Often people with fibromyalgia have diminished
blood flow so they have less functional activity in the brain
in the areas where pain signals are alleviated. In other words,
they have a pain filter that is dysfunctional. The very best
therapy may be moderate, regular aerobic exercise, even though
pain may result and you may have to work through that pain. Exercise
creates more endorphins in the brain and this helps the body to
not feel pain. Exercise also brings more blood flow to the muscles,
and this can help relieve pain. Many people may have to start
moving gradually because they have had so much pain they have
simply quit moving. Exercise will increase the ability to sleep
as well as improve the condition in the long-run. Exercise may
also initially make the pain worse and NSAID's (tylenol, aspirin,
etc.) can be taken for short periods of time to alleviate this
extra pain. Long term use of pain-killers will eventually worsen
the problem because it prevents the natural pain-killing endorphins
from being produced. Narcotic pain killers should not be utilized
for this condition. Tri-cyclic anti-depressants can be helpful,
but avoid newer ones like Prozac, Zoloft, etc. (By the way, a
safe alternative to those taking Prozac may be St. John's Wort,
available at health food stores.) Hot tubs and spa's may be helpful.
Relaxation techniques can be helpful. Avoid doctors that do
not believe in fibromyalgia. This condition is real and has a
biological basis!!
ALTERNATIVE MEDICINE:
Do you have ugly, blue,
dilated veins in your legs? Try butcher's broom, an ancient plant
that contains ruscogenin and neuroscogenin, two natural plant
steroids that seem to narrow dilated blood vessels. This product
also contains an anti-inflammatory agent that soothes the inflammation
around those veins.
I have found an added benefit
of being off the prescription for my sleep disorder (made possible
by my magnetic mattress). My natural killer cell activity is
increasing as is my natural killer cell level. The anti-depressants
we use for our fibromyalgia (which went away with the sleep system
also) and sleep disorders can suppress our immune systems. Apparently
mine was being suppressed.

IMPORTANT:
I speak to many women and I am often astounded (and frustrated)
to find the number of women looking for a magic pill to cure their
disease(s). Many are still running from doctor to doctor looking
for that one thing that will make them feel better. All too often
women are smoking cigarettes and using alcohol, drinking coffee
(the most heavily pesticide laden product in the world) and using
sugar heavily in their diets. The sodas I see being consumed
by many women would put me under the table. Peanuts are laden
with pesticides so that is another thing I see many women consuming.
I am alarmed with the unwillingness of women ill from breast
implants to take charge of their lives and get the chemicals,
food additives and pesticides out of their diets. We will never
recover until we realize the importance of avoiding environmental
toxins and becoming educated consumers about the foods we eat
and the cleaning products we use. You are what you eat!! If
you eat junk, your body will not heal. If you avoid good nourishment
and good nutrition (including good food supplements), you will
pay the price. The only women I see who are getting better are
the ones that are doing what I have done. At our Reno conference,
Colleen Swanson shared the same advice. Many of our group leaders
have realized the tremendous benefits of alternative medicine
including basic nutrition.
BOOKS:
Are you too sick to work?
Have you tried everything to make a living and been unable to
function for more than a day, a week, etc. without becoming much
worse. Have you thought of applying for Social Security Disability
(SSD) or Supplemental Security Income (SSI)? If you did not work
5 of the last 10 years before you became disabled, you may apply
for SSI. For SSI (only), you cannot have any source of income
(spouse, trust fund, relatives) or own a lot of property (not
a problem for many of our women), but it is an alternative for
some. You can receive Medicaid and later Medicare when you receive
SSD or SSI and this pays for removal of implants as well as medical
costs. For an informative book on how to apply and what you need
to do, send $14.00 to COSS and ask for the SS Book. It can save
you a major amount of effort by knowing just what to do and what
records to collect. Don't suffer quietly because of pride!!
These funds are out there for people who are too sick to work!
We deserve them when we are ill and cannot survive without funds!!

so much more damage to me than the cancer ever did!! I was just
beginning to
